We may choose not to accept orders at our sole discretion, even after we send you a confirmation email with your order number and details of the items you have ordered.

GOODS NOT FOR RESALE OR EXPORT

You represent and warrant that you are buying products or services from the Site for your own personal or household use only, and not for resale or exports unless in writing under a contract or an agreement signed by a duly authorized representative of INDICANNACO. You further represent and warrant that all purchases are intended for final delivery to locations within India and to countries we deliver.

INDICANNACO may revise and cease to make available any product at any time. In the event, we are unable to deliver the product to you on time or at all, you will be notified by an e-mail or a call and your order will be automatically cancelled due to unavailability of the product or at your instructions due to failure to deliver the product on the expected time of delivery by our delivery partners.

INDICANNACO shall not be liable to pay for any damages in such an event owing to cancellation of the order or delay in delivery.
From time to time, we may offer promotions on the Site that may affect pricing and that are governed by terms and conditions separate from these Terms.

MODE OF PAYMENT

100% of the purchase price shall be due upon completion of your order and prior to shipment of the product if not using Cash on Delivery (COD).

Payments for the products available on the Site may be made in the following ways:

·  Payments can be made by Credit Cards, Debit Cards, Net Banking, Wallets, e-Gift cards, and reward points.

·  Credit card, Debit Card and Net Banking payment options are instant payment options and recommended to ensure faster processing of your order.

·  Cash On Delivery option is not available for orders outside India.

PACKING AND SHIPPING

We take great care in delivering our products and adhere to the highest quality standards. All items shall be properly prepared for shipment shall be in accordance with the shipping description set out in the confirmation page. You will pay all shipping and handling charges specified during the ordering process. Title and risk of loss pass to you upon delivery to you. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.

RETURNS / REFUNDS AND EXCHANGE POLICY DUE TO PRODUCT QUALITY

INDICANNACO endeavours to ensure that every transaction on our website is seamless and without any hassle. Product quality is exceptionally important to INDICANNACO, and we are fully committed to your satisfaction.

As a policy, we do not offer returns or exchanges on products which are delivered in perfect condition as per the order placed. If you’ve had an incorrect product delivered to you (product doesn’t match the item in the order confirmation), or if the product you receive has a genuine quality / manufacturing defect then we will be happy to exchange your product for a replacement. All items can be exchanged within 3 days upon delivery of products. Items exchanged for the first time will be free of cost, upon any subsequent exchange the charges borne will be levied on the customer. If you’ve received a defective product, send us pictures of the damaged item within the span of 48 hours and upon the same product or an alternative product of your choice failing to be in stock, we will be happy to, following a quality check, offer you a refund which will be processed in 14 working days (after the product reaches us). The refund shall be made through an online mode or refund will be credited back to the same payment method used to make the original purchase on www.Indushemp.in Orders once placed, cannot be cancelled.

If product quality concerns exist, we may request product to be returned for evaluation, which will result in a full refund or product replacement.
 

Our customer care team will look into the issue and respond to you within 72 working hours. We typically make a reverse pick-up within 3-4 working days. Given the nature of our products, we reserve sole discretion to provide resolution as we deem fit. Every return or exchange request is treated as an individual case. We are unable to offer refunds if we’ve been given an incorrect or incomplete shipping address, or if there are three failed delivery attempts by our shipping agency and/or the package is refused by the recipient.

We reserve the right to deny any return or refunds if we believe the return or refund is not made in good faith. The return and refund policy are subject to change without notice.

If you purchased our product through a INDICANNACO distributor or retailer, any returns or exchanges are not applicable. However, you can go to the original purchase location and refer to their return or exchange policy to see if it’s applicable to them.

International Orders: if a customer refuses to pay the Duty as mandated by the respective country of shipment and doesn’t collect the order from our Shipping agency, INDICANNACO will not be liable to provide a refund.

INDICANNACO warrants that all goods supplied under this purchase order shall comply with all applicable central, state, and local laws, rules, regulations and ordinances at the time of delivery; provided, however, the parties hereto acknowledge that the products contain, or are derived from, hemp in accordance with the parties’ understanding of Sections 8 and 14 of the Narcotics Drugs and Psychotropic Substances Act, 1985, read along with Chapters IV-A and V of the Indian Drugs and Cosmetics Act, 1940, read along with the relevant enactments by the respective state governments i.e. under their Excise Acts and Rules, NDPS Rules and DCA rules across India for the purchase of products containing hemp and its by products within their local territories.Though there remains uncertainties as to whether any other central, state or local law may or may not conflict with these stated sets of laws, each party acknowledges that such currently existing uncertainties under central, state and local laws concerning hemp are subject to change at any time in the sole discretion of the applicable authority. Each party hereby waives any defences to the enforcement of this purchase order based on an “illegality of purpose” theory or related defences.

FORCE MAJEURE

INDICANNACO will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Terms when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, lockouts, strikes or other labour disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.

If any provision of these Terms is invalid, illegal, void or unenforceable, then that provision will be deemed severed from these Terms and will not affect the validity or enforceability of the remaining provisions of these Terms.

GOVERNING LAW AND JURISDICTION

This Site is operated from INDIA and all the Terms of Use and the Policies shall be construed in accordance with the applicable laws of India. All matters arising out of or relating to these Terms are governed by and construed in accordance with the internal laws of INDIA. For proceedings arising there in the Courts at Hyderabad shall have exclusive jurisdiction.

DISPUTE RESOLUTION AND BINDING ARBITRATION

(a) YOU ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION. ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT ORFUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN YOU AND US ARISING FROM OR RELATING IN ANY WAY TO YOUR PURCHASE OF PRODUCTS THROUGH THE SITE, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION.

The arbitration will be administered by the Indian Arbitration Conciliation Act 1996 in accordance with the Consumer Arbitration Rules then in effect.

The Terms of Use and the Policies shall be construed in accordance with the applicable laws of India. For proceedings arising therein the Courts at Hyderabad shall have exclusive jurisdiction.

Any dispute or difference either in interpretation or otherwise, of the Terms of Service and other Policies on the Site, between the parties here to, shall be referred to an independent arbitrator who will be appointed by mutually and his decision shall be final and binding on the parties here to. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The seat and venue of arbitration shall be held in Hyderabad.

The right to seek and obtain any injunctive, provisional or interim relief from any court of competent jurisdiction to protect its trade-mark or other intellectual property rights or confidential information or to preserve the status quo pending arbitration.

For disputes relating to orders outside India, International arbitration rules of Indian Arbitration and Conciliation Act 1996 shall apply. The seat and venue of international arbitration shall be Hyderabad.

ENTIRE AGREEMENT

These Terms of Service, our Website Terms, Privacy Policy and Disclaimer will be deemed the final and integrated agreement between you and us on the matters contained in these Terms.
